Terms and Conditions

This agreement (“Agreement”) sets out the terms and conditions between you (“Customer” or “you”) and Binmates (“Binmates”, “we”, or “us”). By using Binmates’s services, you agree to be bound by these terms and conditions. If you do not accept these terms, you may not use our services.

1. Definitions

1.1 “Binmates”
refers to the bin management service, including the website, mobile app, and related services., owned by Fragrance Vaults Ltd, incorporated under the Companies Act 2006 as a private company in England and Wales.

1.2 “Service”
means collecting and returning waste and recycling bins at the Customer’s designated address.

1.3 “Movers”
refers to individuals contracted or employed by Binmates to perform bin management services.

1.4 “Software”
refers to all software provided for use in connection with the Binmates service, including updates and related documentation.

2. Home Access

2.1 By subscribing to Binmates, you authorize us and our Movers to access your property to perform bin collection and return services.

2.2 You confirm that you have the legal right to grant access to the property and ensure the bins are accessible on scheduled service days. If access is blocked, services will not be performed, and you will not be entitled to a refund or credit.

3. Service Description

3.1 Binmates provides a bin collection and return service on designated waste collection days.

3.2 The service includes up to one waste bin and one recycling bin per week for a fixed monthly fee, covering up to four visits per calendar month.

3.3 You are responsible for providing accurate collection schedules, gate codes, or other required access information to enable the service.

4. Pricing and Billing

4.1 The monthly service fee is stated on the Binmates website and is inclusive of applicable VAT.

4.2 Binmates reserves the right to change the service fee with “60 days” written notice. Continued use of the service constitutes acceptance of the revised fee.

4.3 Payment is due monthly in advance. If payment is not received by the due date, services may be suspended.

5. Payment Terms

5.1 By subscribing to the service, you agree to enrol in Binmates’s recurring payment plan. Payments will be automatically charged to your designated payment method.

5.2 If a payment is declined, Binmates will retry the payment method up to 8 times within 2 weeks. Failure to resolve payment issues may result in service suspension.

6. Cancellation

6.1 You may cancel your subscription by providing 30 days written notice via our website or email.

6.2 No partial refunds or credits will be issued for unused portions of the service during the billing cycle.

6.3 Volume accounts (e.g., multiple properties) require 90 days written notice for cancellation

7. Liability and Indemnity

7.1 Binmates shall not be liable for:

7.2 You agree to indemnify Binmates against any claims, damages, or costs arising from your use of the service, including failure to comply with local regulations.

8. Safety and Access Requirements

8.1 You must ensure that:
Damage to waste or recycling bins caused by third parties, acts of nature, or misuse.
Fines or penalties imposed by local councils or homeowner associations due to improper bin management.
Damage caused by vehicles hitting bins.
Gate codes, lock combinations, or security access details are provided and functional.
Pets are restrained to prevent interference with the service.

8.2 Binmates reserves the right to refuse service if safety conditions are not met.

9. Customer Satisfaction

9.1 If a service is not satisfactorily completed, you must notify Binmates within 7 days to allow for resolution.

9.2 Our goal is complete customer satisfaction. However, unresolved disputes will be addressed as outlined in Section 12.

10. Changes to the Service

10.1 Binmates reserves the right to modify, suspend, or discontinue any part of the service at any time with prior notice.

10.2 Changes to these terms will be communicated via email or the website. Continued use of the service after changes constitute acceptance of the revised terms.

11. Data Protection and Privacy

11.1 Binmates processes personal data in accordance with UK GDPR and the Data Protection Act 2018. Refer to our Privacy Policy for details.

11.2 By subscribing to the service, you consent to receiving notifications, service updates, and marketing communications from Binmates. You may opt out at any time.

12. Disputes and Governing Law

12.1 This Agreement is governed by the laws of England and Wales. Disputes will be resolved in accordance with UK consumer law.

12.2 Any dispute arising from this Agreement shall be subject to binding arbitration under UK arbitration rules. If arbitration is unavailable, disputes will be resolved in the courts of England and Wales.
